    PROPERTY RENTAL TERMS

    By confirming your booking and paying the required deposit directly, or through HomeAway, VRBO, Tripadvisor, or any other similar service, you are agreeing to all terms in this contract.

    As the primary tenant(s) you agree to abide by all rules, regulations, and guidelines set forth in this document and take responsibility for the actions of all individuals on premises during your stay.  You also understand and accept that you are entering into a vacation rental agreement with NOLA Invest I, LLC for use of the property at 3614 N Rampart Street, New Orleans, Louisiana, 70117 for the dates reserved online.  Please verify the accuracy of your reservation dates and total cost with VRBO, HomeAway, TripAdvisor, or similar service used to book your reservation.

    RESERVATION POLICIES:

    1. COPIES OF IDENTIFICTION (ID'S): Within 7 days of booking, Guest must email clear copies of the ID's of each guest on the reservation or risk cancellation. Write the name of main guest and reservation dates in the subject line. Feel free to copy (CC) each guest on your reservation if you'd like so they have our contact information. Each ID must be valid and current at the time of submission plus be valid during the entire dates of the reservation. To avoid confusion and errors, email all ID's in one (01) email to: INFO@MAISONROUGAROUX.COM 

    2. ADDITIONAL WRITTEN RENTAL AGREEMENT: could be requested and necessary. If requested, Rental Agreement will list all guests in the reservation using the ID's provided and is to be digitally signed only by the main guest within 7 days of said request or risk cancellation. Both the online Property Rental Terms and the written terms of the rental agreement will work in conjunction with each other.  The stricter of any duplicate clauses will supersede. *Stays/reservations longer than 28 days must sign a written rental agreement. 

    3. CHECK IN AND CHECK OUT:  Early check in and late check out is by prior approval only. We do our best to accommodate these requests, but we often have guests checking in and out on the same day so we cannot guarantee any exceptions until 24 hours prior to arrival and departure. 

      1. Check In time is 4:00pm Central Time on the first day of your reservation.  

      2. Check Out time is 11:00am Central Time on the last day of your reservation.

      3. When available (24 hours prior to requested event) there is a $50.00 fee for early check-in (and) $50.00 fee for late check-out. There is never a fee for luggage storage.  Based on availability, the earliest check-in is at 7:00am and latest check-out at 4:00pm.  If you paid the $50.00 add-on fee at booking and we cannot accommodate your request we will refund you 100% of the $50.00 fee(s) when applicable.      

      4. Unapproved late checkouts will be charged at $250 per hour. 

      5. Third party reservations are never allowed and are subject to immediate cancellation and cancellation policy(s). Third party check-in: Do not send anyone in your group to check-in on your behalf without 1st making previous arrangements with us. 

      6. Luggage storage: is available at no cost, when we cannot accommodate a late check-out or early check-in 

      7. Arrivals: A lot of preparation goes into your arrival so we need you to communicate with us when that will be. If you plan to arrive late please let us know as soon as you can so we can make arrangements for you. Unless you arrive late (i.e. after 7 or 8 pm) someone will meet YOU (not another person in your group unless you make previous arrangements) at the location to give you a tour and answer any questions that you and your group may have.

      8. Requirement for Timely Reporting of any damage: Guests are obligated and responsible to immediately report rental damage, or else they may be held responsible for damages.

    4. PAYMENT: To make things easy for our guests, we can accept direct bookings or those through third party sites (e.g. Airbnb, VRBO, HomeAway etc).  The payment terms and details may differ depending on booking source, so please refer to each platform for specifics.  In the event there is any ambiguity, this agreement will default to the stricter payment terms and requirements.

      1. Third Party Sites: Payment for reservations made through third party sites (e.g. Airbnb, VRBO, HomeAway etc) will be handled according to the policies and schedules of the given platform.  All payments must be received at least seven (07) days prior to check-in date and are non-refundable after that time.  

      2. Direct Bookings:  A deposit of fifty percent (50%) of the agreed rental amount is due at time of booking twenty-five percent (25%) due 180 days days before arrival and the remaining balance is due ninety (90) days before arrival. The advance payment(s) is not a damage deposit and this money will be applied toward the total rental amount. Payment can be online through personal check or credit card via a link provided at time of reservation confirmation.  The BALANCE is due thirty (90) days before your arrival date or sooner to confirm your booking. If the balance is not received at least thirty (90) days prior to arrival, you will forfeit your reservation and the space may be opened up for another group - with no refunds of any payments previously made.

    5. DAMAGE/RESERVATION DEPOSIT: In addition to the rental fees, we require a $2,500 USD damage deposit in the form of a pre-authorization to your credit card due one (01) day before arrival and released seven (07) days after departure. The deposit is NOT applied toward rent; however, it is fully refundable within seven (07) days of departure, provided the following provisions are met:   *if you prefer, we can invoice at the time of booking $89.00 for $3,000.00 Property Damage Protection Policy

      1. No damage is done to estate or its contents, beyond normal wear and tear.

      2. No charges are incurred due to contraband, pets, or collection of rents or services rendered during the stay.

      3. All debris, rubbish and discards are placed in refuse containers outside, and soiled dishes are placed in the dishwashers and started. No need to start laundry.

      4. No early check-in or late check-out unless prior approval was received.

      5. No linens are lost or damaged. No body glitter, creams, self-tanners of any kind (shower before bed IF you do). No using towels to remove make-up ONLY use provided make-up wipes. All soiled linens will be pre-treated and washed more than once but if any become permanently stained, you will be billed for full replacement value of original purchase price. 

      6. No colored liquids of any kind including but not limited to: coffee, tea, red wine, beer, liquor, allowed on upstairs in bedrooms / nightstands / bathroom ONLY water is allowed upstairs if on provided coasters. There is also NO colored liquids allowed on kitchen table or kitchen and bathroom counters without the use of coasters. This is to prevent staining of white quartz counters that cannot be spot treated only the entire surface can be buffed and re-sealed. 

      7. No decorating of any kind including but not limited to tape on walls, confetti, glitter.  Any damage caused by "decorations" will be billed to you after your stay.  

      8. No shoes. Remove your shoes upon entering the residence, there is a shoe rack in foyer. Any damage caused to floors will be billed to you after your stay. 

      9. Do not drag luggage upstairs it will scratch the wooden stairs and you will be billed for the damage after your stay. Please CARRY all luggage up the stairs.

    6. PROPERTY DAMAGE PROTECTION POLICY: If you prefer, we can invoice at the time of booking $89.00 for $3,000.00 Property Damage Protection Policy. A damage Protection is in lieu of a traditional security deposit, where for a nominal non-refundable fee, it protects the guest for accidental damage up to the limit of coverage selected. Should damage occur, claims are processed online, the owner will be the beneficiary and the expense incurred for repairs or replacement is reimbursed to the property owner/manager up to the limit of the policy coverage selected.       1. Coverage. Property Protection Programs cover damage to property contents only due to unintentional, accidental acts (“damage protection”) providing coverage limits of $3,000 at a flat rate per stay.

      2. Duration. The length of coverage ranges from 1 to 30 days depending on the length of guest stay. Coverage for day 31 and beyond requires the purchase of additional coverage in 30-day time increments.

      3. All guests/renter address/contact information, trip total, trip dates, and destination address information will be required upon initiating a claim for losses. Claims must be guest-verified

      4. Rental occupancy conduct requirements: even though guest participates in the Damage Protection Program, the guest may still be held financially responsible, and a charge made against the Deposit or credit card, for the following: (1) wanton destruction of property, gross negligence, failure to mitigate foreseeable damages, failure to notify management of known damages, and theft. Terms and Conditions

      5. IN THE EVENT OF DAMAGE. In order for the insurance policy to be in effect, Guests must report any accidental damage (in writing via email and attach any supporting digital photos or video) prior to their departure, otherwise Guests may be liable for payment for repairs or replacement. 

      6. Claims Filing Procedures: Contents Only Claims may be submitted online at www.damageprotection.insure/claims  OPEN A CLAIM within fourteen (14) calendar days of the Covered Booking Check-Out Date by completing the online form and uploading photo(s) of the damage. COMPLETE CLAIM DOCUMENTATION within forty-five (45) calendar days after Opening the Claim.

      7. RENTAL AGREEMENT CLAUSE RE: Damage Protection - Our properties and their contents are valuable and reasonable care should be taken with them during your stay. Our company, including the participating rental property homeowners we represent (“we”, “our”, “us”), is an additionally insured participant in a Property Protection Program that reimburses certain costs for unintentional accidental damage to our properties during their rental occupancy. With our participation in this Program, except in certain circumstances, we may not collect and hold damage, or security deposits, except in the case of a pet deposit (if applicable) as pet damage is not covered under the policy. We charge renters a non-refundable administrative fee to defer our costs for Program participation. If, during a renter’s occupancy, the renter or a member of renter’s party or renter’s guest causes any damage to real or personal property of our rental property as a result of unintentional accidental acts or omissions, the renter must notify our property management office at that time, and before check-out. For rentals that exceed the coverage limits of the Program, we may collect a supplementary refundable (net of any damage reimbursement) security deposit from renter upon check-in. Renter is liable to us for any damages caused by the renter or a member of renter’s party or renter’s guest that are not reimbursed to us or exceed the maximum per-incident limit of our coverage, and the credit card on file and/or any collected security deposit will be charged. If the renter wishes to pay a refundable (net of any damage reimbursement) damage security deposit, renter must notify us before check-in. Special or large events and/or pet deposits may be charged in certain situations.

      8. TERMS OF COVERAGE

        1. This Waiver takes effect upon check-in or registration on the booked arrival date to a Protection Brands approved property management rental unit, together with receipt of payment of the Waiver Fee at or before check-in.

        2. This Waiver shall terminate upon normal check out time of the Protection Brands approved property management rental unit or the departure of the Renter, whichever occurs first.

      9. Damage Term of Waiver Description: IF YOU ACCEPT THIS WAIVER, THIS DOCUMENT BECOMES PART OF AND IS ATTACHED TO THE RENTAL LEASE AGREEMENT.

    7. CANCELLATIONS: All cancellations will incur a minimum five percent (5%) fee or $50 (whichever is greater) for processing of bank and merchant fees, with schedule as follows:

      1. 90 days before arrival check-in time or earlier: full refund of total rental fee(s) paid.

      2. Between 60 and 89 days prior to the stay: refund of 50% of total rental fee(s) paid. 

      3. Between 30 and 59 days prior to stay: refund of 25% of total rental fees(s) paid. 

      4. Fewer than 30 days prior to stay: no refund and forfeiture of all funds paid.

    8. MINIMUM AGE: The minimum rental age is 30 years old, unless accompanied by a parent or guardian. The property is not safe or suitable for children (0-12 years) - email or message to discuss.  

    9. MAXIMUM OCCUPANCY: The maximum sleeping occupancy of the house is 08 people.  If you have more than 08 people sleeping on site, you will be charged $200 per person, per night. Also if you booked for 01 to 06 people but have a 7th or 8th person we will BILL you the ADDITIONAL GUEST FEE ($30.00 per person per night) for the entire number of nights of your reservation up to 08 people, regardless in which night we make the finding. If we do not receive payment for the additional person(s) we will deduct the monies owed from either the security deposit or damage waiver.  

    10. NON-SMOKING: This is a NON-SMOKING home.  Smoking is only allowed outdoors in designated areas and if disposed of properly. All cigar/cigarette butts must be disposed of in front yard trash cans. If you dispose of butts on the ground or indoor trash cans or smoke indoors, there will be an additional cleaning fee of $500. Disposing of butts on the ground is a FIRE HAZARD. 

    11. PETS: Not suitable for pets. Pets are not permitted in any way. Due to owners health conditions, we are sorry but we cannot accept service animals or emotional support animals. Any evidence of pets on property will automatically forfeit 100% of the security deposit and/or damage waiver or both. If no security deposit was received you will incur a fee equal to the same amount of the total cost of your stay. Fleas and ticks are very rampant in this area and can cause harmful/fatal illness to humans and pets. All items above are the sole responsibility of the pet owner. The property owners assume no responsibility for illness or injury that may occur to pets or humans while on the premises.

    12. HOUSEHOLD SUPPLIES: The house will come with an initial supply of hand soap, dish-washing detergent, laundry detergent, paper towels, toilet paper, and garbage bags. Additionally a variety of spices and cooking ingredients may be available for guest's use. This initial supply should suffice you during your stay. We have never had a guest run out of these supplies. However, all other household and cooking supplies needed shall be the responsibility of the tenant.

    13. PARTIES AND EVENTS: While we do allow certain events on site (for only the number of people in your reservation), there shall not be any house parties, weddings, receptions, or other events (personal or commercial) on the premises without express, prior written approval.  If you violate this rule, you will face immediate eviction and loss of all rental payments as well as the security deposit and or damage waiver or.  

    14. NOISE: The house is in a residential neighborhood and we do our best to be respectful of our neighbors. As such, we do not allow outdoor amplified music or any other loud noise between the hours of 10:00pm and 8:00am Central time.  We are in the process of installing decibel meters throughout the property and are notified should outdoor noise levels exceed reasonable limits.  If the police are called, there will be a minimum of $500 deducted from the security deposit.     15. TOWELS AND LINENS: Rates include a one-time linen-towel setup. Unless agreed upon prior to the stay, subsequent towel and linen services will be at the cost of the tenant(s). Typically there are two towels and two pillows per person. 

    16. CLEANING: Tenant(s) agree to keep the property clean and safe throughout the duration of their stay.  No junk or garbage will be allowed to accumulate on or near the premises. All garbage shall be promptly sealed in plastic garbage bags to help prevent odors and insects. 

      1. Daily Maid Service: While linens and bath towels are included, daily maid service is not included in the rental rate.  It may be available for an additional fee by request.

      2. Dishwasher: prior to your departure, load and start the dishwasher. 

      3. Refrigerator: prior to your departure, empty out the refrigerator of all open food items and dispose of in kitchen trash can.

      4. Garbage: prior to your departure, remove trash from all receptacles and place all trash bags in outdoor trash cans. 

      5. If your stay is longer than twelve (12) days we must add additional weekly cleanings starting on day seven (07) of your stay and each subsequent seven (07) days after that at a weekly cost/rate equal to the same cleaning fee quoted at booking.  Typically no less than $195.00 (no discounts) weekly (per cleaning) because that is what we pay to get the property professionally cleaned. Example if you stay 13 days you will be charged for two (02) cleanings and the cleaner will visit the property on day seven (07) of your stay to clean and again after you check-out on day thirteen (13). 

    17. PARKING: Parking is limited to one (01) vehicles on site (off street).  There is ample street parking on Rampart, Congress or Independence Streets. Vehicles are to be parked in designated parking areas only. Any illegally parked cars are subject to towing; applicable fines/towing fees are the sole responsibility of the vehicle owner.  

      1. We use a Bluetooth enabled padlock that requires a unique code be sent to your smartphone in order to unlock the driveway padlock so you must notify us in advanced if you intend to bring a vehicle and will need a unique code be created for you during your stay. If you do not notify us in advance you will not be able to unlock the gate and park your car off-street until you first request an obtain a unique code from us. 

    18. WEATHER CONDITIONS & TRAVEL INSURANCE: No refunds will be given for storms.  Severe wind and rain do occur in the Greater New Orleans area, we do not refund due to weather conditions.  You may want to consider purchasing optional travel insurance (e.g. www.travelprotection.insure) (e.g. www.insuremytrip.com) that protects your vacation investment against unforeseen events like a hurricane, sickness, injury, flight cancellation, job loss and much more. 

    19. PROPERTY MANAGER:  The owners are generally not on site, but there is a local guest concierge and property manager who lives nearby and can answer any questions or assist with issues that may arise during your stay. The property manager’s phone number is located in your Welcome Email and in the Welcome Book inside the house. Please notify the property manager of any damage or other issues prior to check out. 

    20. REVIEW(S): After your stay, please take 3-5 minutes to share your experience with other travelers by writing a REVIEW and providing your feedback to us.  This helps future travelers know what to expect from us, plus helps us always strive for excellent service and creating wonderful guests experiences.  And so your future Hosts can better get to know you, we promise to write a review for you as well.  

    21. CAMERAS: We are in the process of installing 04 exterior security cameras to ensure not only the safety of our guests but to ensure ALL the house rules are being followed. NO cameras will be inside the home. Cameras will be located as follows: Camera #01 will be at the Street Front Door porch. Camera #02 will be at the Main Front Door porch Camera #03 will be at the Rear Back Porch and Camera #04 will be at the Rear Side yard facing the vacant lot next door.  Again, NO cameras will be inside the home. And once they are installed, we anticipate all 04 cameras will always be on. 

    22. BUGS:  Louisiana is home to many type of bugs & insects not commonly known anywhere else.  Especially during the hot months (May to Aug - Sept).  To prevent infestation, we are under quarterly contract for pests and yearly contract for termites. In order to minimize pest entry keep ALL windows and doors CLOSED and locked at all times.  Some bugs do fly (i.e. termites, cockroaches, little black bugs w-a red spot). DO NOT BE ALARMED IF YOU SEE / FIND BUGS INSIDE OR OUTSIDE IT IS LOUISIANA 

    23. REFRIGERATOR: The LEFT side door must be closed 1st then the right in order for it to close & seal properly ... this is just how it was manufactured ... weird i know. 

    24. ANTIQUE ROOM:  Be extra careful in the upstairs Antique Room.  This furniture cannot be replaced and is very valuable. Any damage here will be expensive. 

    25. UMBRELLAS:  New Orleans weather can change from 1 hour to the next so for your comfort and use we provide large nice umbrellas.  They are not expensive yet we cannot afford to keep replacing them each time a guest checks out. So please be mindful when you use the umbrellas to not leave them behind at restaurants etc. Please bring them back to the house for the next guests to enjoy them just like you did. 

    26. ALARM & FALSE ALARMS:  $195.00 FALSE ALARM fee - If the Police are dispatched to the house SO if you set off the alarm (at 4:30 AM or any other time) CALL your Local Host IMMEDIATELY for assistance (or) we will send you an amended reservation (or) invoice for $195.00 due and payable right away.  This is the fee we MUST pay the City so it is passed on to you. . 

    27. RATE CHANGES: Until a reservation is confirmed and fully paid, all rates are subject to change without notice.

    28. HOLIDAYS: (04) NIGHT MINIMUM at a minimum base rate of "NO LESS" than $599+ per night on all major holidays, special events & local festivals including but not limited to: Jazz Fest, Mardi Gras, Decadence, French Quarter Festival (FQF), ESSENCE Festival®, New Years, Christmas, Thanksgiving, Halloween, St. Patrick's, Easter, Memorial Day, 4th July, Labor Day, Veterans Day, Columbus Day, MLK, Presidents Day, etc (and) management reserves the right to amend any reservation to meet both the increased minimum nightly base rate for a minimum of no less than (04) nights (or) without penalty to either party, cancel said reservation should guest not agree to the aforementioned.  Furthermore, reservations are only allowed up to 12 months in advance. Any reservations made for 12+ months in advance may be cancelled at management discretion without penalty to either party. NOTE: There are approximately 130 festivals in New Orleans each year, which equates to roughly one festival every three (03) days. 

    29. FALSIFIED RESERVATIONS: Any reservation obtained under false pretense will be subject to forfeiture of advance payment, deposit, and/or rental money, and the party will not be permitted to check in. This includes 3RD PARTY RESERVATIONS they are not allowed. If discovered after check-in, it is grounds for immediate cancellation of your reservation, your entire group will be asked to vacate the property immediately and you will forfeit any and all monies already paid.  

    30. OCCUPANCY TAX COLLECTION IN LOUISIANA: 

      State of Louisiana

      Guests who book listings that are located in the State of Louisiana will pay the following taxes as part of their reservation:

      • Louisiana Sales and Use Tax: 4.45% of the listing price including any cleaning fee for all reservations. For detailed information, visit the Louisiana Department of Revenue website.

      New Orleans

      Guests who book listings that are located in the New Orleans, LA will pay the following taxes as part of their reservation:

      • New Orleans Sales Tax: 5% of the listing price including any cleaning fee for reservations 59 nights and shorter. For detailed information, visit the New Orleans Short Term Rentals website.
      • New Orleans Hotel Occupancy Privilege Tax: $0.50 per night. For detailed information, visit the New Orleans Short Term Rentals website.
      • STR Occupancy Fee: Nightly fee based on listing type for reservations 29 nights and shorter. For detailed information, visit the New Orleans Short Term Rentals website.
      • STR Equalization Occupancy Tax: 6.75% of the listing price including any cleaning fee for reservations 29 nights and shorter based on listing type. For detailed information, visit the New Orleans Short Term Rentals website.
    31. WRITTEN EXCEPTIONS:  Any exceptions to the above mentioned policies must be approved in writing in advance.

    32. NO LIABILITY/INDEMNIFICATION/HOLD HARMLESS: The owners of the property and NOLA Invest I, LLC do not assume liability for the loss, theft, damage, or injury (or death) to persons or their personal property. Tenant(s) agree to indemnify and hold the owners and their representatives harmless for any liabilities, theft, damage, cost, or expense whatsoever arising from or related to any claim or litigation which may arise out of or in connection with tenant’s use and occupancy of the rental property, including but not limited to claims for personal injury or property damage/loss.
